PHILIPPINES: DOLE Agents’ Accreditation and Authorized Representative Appointment

On 31 January 2022, the Department of Labor and Employment (DOLE) issued an order requiring third party providers transacting with their office to complete an accreditation process and, thereafter, be appointed by their clients as authorized representatives before they are able to lodge the alien employment permit applications on behalf of their clients.
The accreditation will have to be applied for by the third party providers and they must complete this before 18 July 2022, which is the date when the authorities will implement the new requirements for filing on behalf of clients. It will be valid for two (2) years initially and is renewable.
Upon completion of the accreditation, the third party agents must work with the clients to appoint them as the authorized agency by way of issuing a Service Contract/Agreement and including them in the Board Resolution/Secretary’s Certificate.

The new accreditation for agents limits the number of persons that will be able to transact with DOLE going forward and it will be important to ensure that third party agents engaged in assisting with the Philippine work visa filings are compliant with the new requirements to ensure there are no delays with regard to the filing of Alien Employment Permits (AEP).
