The Czech Republic amended the Employment Act in December 2023, introducing several changes affecting foreign workers. In order to attract new talent and develop a competitive workforce, two key changes have been implemented. 1) The rules on the labour market test have been relaxed, and 2) for a selected list of countries, free access to the labour market has been granted.

Relaxed labour market test rules.

The labour market test is the requirement to prove that is not possible to find a resident worker (Czech national or EU/EEA/Swiss national) to fulfil a position, before offering it to a third-country national. It is conducted by posting the vacant position on the Labour Office online platform for a duration of 10 to 30 days before proceeding to the next stage of the application. The labour market test is generally required for Employee Card and EU Blue Card applications.

Since July 1, 2024, the relaxed labour market test rules mean that:

  • Employers will still be required to ensure that a job vacancy has been posted on the government online platform.
  • Employers will no longer be required to advertise the opening for 10 to 30 days before beginning the hiring process of a third-country national worker.
  • The third-country national can submit the Employee Card application as soon as the vacancy number is issued (within 1-3 days of the posting).

Please note that the Labour Office will now have the right to remove a position from the vacancy register after six months of posting. Employers who have posted vacancies in advance as a precautionary measure should adjust their practice.

Free access to the labour market for selected countries.

As part of a pilot scheme, nationals of selected countries have been introduced as a new category of beneficiary of the work permit exemption. The list of work permit-exempt countries includes Australia, Canada, Israel, Japan, New Zealand, Singapore, South Korea, the UK, and the USA.

It is possible that the list of work permit-exempt countries could be expanded, following a successful pilot of the scheme.

Effective July 1, 2024, the work permit exemption applies as follows:

  • No work permit (and no vacant position posting) is required for nationals in work permit-exempt countries when working in the Czech Republic more than 90 days.
  • Long term visa/residence permit requirements still apply.
  • Local registration requirements still apply.
  • Working whilst a visitor in the Czech Republic is still not permitted, unless an alternative exemption applies. If a national from a work permit-exempt country is required to work in the Czech Republic for fewer than 90 days (subject to the Schengen allowance), they will be required to obtain a work visa (referred to as a Schengen C visa for work purposes) before travelling to the Czech Republic.
  • EU Blue Card and ICT categories are excluded from this exemption.

With these changes to the labour market test and the granting of free access to the Czech Republic labour market to nationals from certain work permit-exempt countries, employers should now benefit from a faster hiring process. However, employers are reminded to note that these changes do not grant permission for third-country nationals to work in the Czech Republic whilst as a visitor, unless another work permit exemption applies.

In an effort to streamline work and student permit processes, the Swedish Migration Agency has introduced a pilot scheme to allow nationals from 23 countries to complete the passport verification requirement using an application on their mobile phone or computer instead of attending in person to a Swedish Embassy or Consulate. Eligible applicants include nationals from Albania, Argentina, Australia, Bosnia and Herzegovina, Brazil, Canada, Chile, Colombia, Georgia, Hong Kong, Japan, Malaysia, Mexico, New Zealand, North Macedonia, Peru, Serbia, Singapore, South Korea, Taiwan, UK, Ukraine, and the USA.

It is anticipated that eligible applicants will receive an email from the Swedish Migration Agency within a few days of submission of the work or student permit application. The email will contain a link to the online service to complete the verification process online.

The introduction of the online verification will hopefully allow faster processing of applications and will be more cost effective to applicants. However, with many new online services, there may be some potential issues during the initial implementation phase.

In the ever-evolving landscape of global mobility and immigration, the year 2024 stands as a pivotal moment for significant transformations and technological advancements. As nations strive to attract highly skilled professionals while ensuring robust border security, let’s explore the intricate dynamics and forward-thinking strategies that are shaping the future of global immigration and mobility.

Entry/Exit System (EES)

The EU Entry/Exit System (EES) is an automated system for registering travellers from third-countries, both short-stay visa holders and visa exempt travellers, each time they cross an EU external border. The system will register the person’s name, type of travel document, biometric data (fingerprints and captured facial images), and the date and place of entry and exit, all while fully respecting fundamental rights and data protection.

The introduction of this system will ensure that travelling to European countries is more efficient and removes the need for passport stamping and border control procedures on arrival as registration will be done at the external border. The EES will also make it easier for immigration officials to identify any traveller who has overstayed in EU countries or confirm if an individual has no right to enter.

Whilst the exact date that the EES becomes operational is still to be confirmed it is expected to be in place in or around October 2024.

Digitisation Persists

Throughout 2024, we expect to see an increase in countries continuing to leverage advanced online filing systems to simplify immigration procedures. Governments have continued to phase out mandatory requirements to submit hard copy applications, with the widespread adoption of electronic visas expected to become more standard practice.

For example, the Australian Government are looking to implement changes that will improve the migration system’s efficiency. Their plans include streamlining visa application routes and enhancing overall user-friendliness within the immigration system.

Countries such as Kenya have recently implemented digital pre-travel security checks for visa-waiver nationals through electronic travel authorization systems. This will eliminate the requirement to obtain a visitor visa for Kenya. The UK are also preparing to introduce the ETA in 2024 and final preparations will be made for the implementation of ETIAS in EU/Schengen which has a revised start date to begin in 2025.

Global Talent Dynamics

The competition for global talent will remain as organizations seek specialized skills. Countries will prioritize attracting and retaining highly skilled professionals to drive economic growth. In December 2023, Ireland’s Department of Enterprise, Trade & Employment announced an increased eligibility for employment permits for non-EEA nationals adding 11 roles to the Critical Skills Occupation List and made an additional 32 roles eligible for a General Employment Permit.

The recent update to the EU Blue Card is another example that demonstrates greater facilitation of the movement of foreign nationals, specifically within the EU. Once the EU Blue Card holder has completed 12 months employment in the first member state (which was previously required to be 18 months) they may then be eligible to enter, reside, and subsequently work in a second member state within 30 days of filing a simplified new EU Blue Card application. Time spent on the EU Blue Card in the first Member State will count towards the legal residency requirement for obtaining EU Long Term Residency status in the second member state.

Furthermore, remote work visa options and digital nomad visas continue to be considered by an increasing number of countries as a means to attract foreign workers and accommodate the rise in flexible work arrangements. South Korea have recently begun a pilot operation of the digital nomad visa which began on January 01, 2024. This visa allows foreign nationals to work remotely while being able to avail of an extended stay in South Korea. The foreign national must be employed outside of South Korea.

Another emerging trend is that of governments choosing to extend visa-waiver options to nationals of additional countries. From March 2024, Thailand and China will permanently waive visa requirements for each other’s citizens. Additionally, China is granting a visa waiver to nationals of six countries (Germany, France, Spain, Italy, Malaysia and the Netherlands), who will be able to visit China for up to 15 days for business, tourism, family visits and transit purposes.

Despite all the above-mentioned measures being introduced to lure foreign talent, protectionist measures will persist due to ongoing economic challenges. Governments will need to navigate a delicate balance between global talent acquisition and safeguarding jobs for local workers. Hungary is introducing changes to existing immigration rules, with an aim to tighten their immigration regulations.  In the second half of 2024, elections will take place in the United Kingdom and United States and the outcome of these will determine immigration policies in both countries.

Immigration Compliance and Enforcement

Governments will intensify efforts to enforce immigration compliance by way of visa inspections and increased scrutiny of purpose of travel at borders.

For example, we have recently observed German immigration authorities requesting temporary reinstatement of internal Schengen borders.  We also anticipate an increase in inspections to verify posted worker compliance in EU and EEA countries as well as more focus on the social security aspect of compliance (A1 form).

Countries including the US, Canada, and South Africa continue to grapple with huge application backlogs, largely rooted in the COVID-19 pandemic. These backlogs leave foreign nationals in a state of limbo for extended periods and lead to some seeking more efficient administration and security elsewhere, which is problematic, particularly in the case of highly skilled migrants. The United States Department of Homeland Security plans to make changes in 2024 to the process for adjustment of status to permanent residence. This change is anticipated to reduce processing times and promote the efficient use of immediately available immigrant visas

Preparing for the Next Global Challenge

Finally, companies increasingly find themselves operating in challenging locations and subject to adapting to the latest “polycrisis”. Emergency situations and the need for crisis management are becoming increasingly common and require complex strategic solutions. The need for urgent international travel—either in to or out of locations—can result from many types of emergencies: from natural disaster to pandemic; from political upheaval to military conflict.

We also anticipate growth and high volumes of movement in the Middle East and particularly Saudi Arabia. Authorities in Saudi Arabia have introduced a tourist eVisa, which allows foreign nationals to take part in tourism-related activities such as events, family and relatives visits, or leisure activities. It is also anticipated that Saudi Arabia will introduce an eVisa for business travel. With Saudi Arabia being the sole bidder for the FIFA World Cup in 2034, we expect that this will create a significant increase in job opportunities for companies seeking to hire foreign talent.

As of January 1, 2024, South Korean Consulates and Embassies have been able to issue a new Digital Nomad (Workaction) visas. This visa allows foreign nationals to work remotely while enjoying an extended stay in South Korea.

To be eligible for the new visa, foreign nationals must meet the following requirements:

  • Must be 18 or older
  • Must remain employed outside of South Korea and any work conducted must be for the benefit of an employer abroad
  • Must have worked for their employer abroad for at least one year
  • Cannot be employed by a South Korean company
  • Must earn minimum of 84.96 million won (approximately USD 65,860) per year
  • Must have evidence of private health insurance with coverage of at least 100 million won
  • Must not have a criminal record

If eligible, foreign nationals will be able to stay and work remotely in South Korea for an initial period of up to one year, which can be extended for a further year. Immediate family members, including spouse and dependent children under the age of 18 can accompany the applicant.

Travelers headed to Vietnam will now be able to get an e-visa upon arrival at more than 50 points of entry in the country. This change took effect on 15 August.

All eligible foreign visitors may now apply for e-visas when arriving by sea, land, or air at a participating entry points in Vietnam. These visas are valid for up to three months and allow for multiple entries. A full list of entry points where e-visas can be obtained can be found here.

In addition, passport holders from visa-exempt countries – Belarus, Denmark, Finland, France, Germany, Italy, Japan, Russia, South Korea, Spain, Sweden, and the United Kingdom – may now stay in Vietnam for up to 45 days. Previously, visa-exempt travelers were limited to a stay of just 15 days.

In the wake of ongoing political unrest in the western Africa country of Niger, the US State Department has issued a level 4 travel advisory for the nation.

A level-4 advisory means Americans should not travel to Niger. In addition, non-emergency government personnel have been ordered by the State Department to leave the country. The US embassy in Niamey, Niger has also warned it will have limited ability to assist any American citizens currently in Niger.

The advisory comes after a group of military officers placed the sitting president under house arrest and assumed control of the government. The State Department warns in addition to potential violence due to civil unrest, there is an increased risk of terrorism, due to the current chaotic security situation.

A number of other countries, from Ireland to South Korea, have also advised their citizens to leave the country.

The National Assembly of Vietnam has made several changes to the country’s immigration laws affecting visas, e-visas, and entry requirements. The changes will go into effect on 15 August 2023.

The duration of e-visas is expected to increase from 30 days to up to three months, and will now allow for multiple entries into Vietnam, rather than the single-entry e-visas currently in use. Currently, passport holders from 80 countries, including the United States and United Kingdom, are eligible for e-visas.

Further, the visa exemption duration will be extended from 15 days to 45 days for regular passport holders of the United Kingdom, Germany, France, Italy, Spain, Sweden, Russia, Finland, Denmark, Japan and South Korea (unilateral exemption).

As of March 10, 2023, travelers from Mainland China, HK and Macau are not required to provide negative COVID test results upon their entry into the US. Since mid Feb, more than 40 countries have gradually dropped or relaxed the entry requirements for travelers coming from Mainland China, HK and Macau. These countries include Australia, South Korea, Japan, European countries, Sweden etc.

Meanwhile, some China Embassies/Consulates abroad have also announced that PCR tests will not be mandatory for travelers entering China.

In the meantime, visa-free policies of following programs will be resumed: Hainan 59 country visa free entry policy, 15-day visa free travel for cruise groups at Shanghai ports, visa free entry to Guangdong province for foreigners’ group from Hong Kong and Macau SARs, Visa free entry to Guilin of Guangxi autonomous region for tourist groups from ASEAN countries.

China has been in the process of reopening to foreign visitors in the wake of the COVID-19 pandemic. China lifted its quarantine-upon-arrival requirement and has begun issuing certain types of visas to foreign visitors. As interest in traveling to China is growing, here is the current state of Chinese government policies towards foreign visitors.

First, it is important to note at this time China is still not issuing tourism visas. There is expectation that China is looking to restart its tourism sector, but currently tourist visas are still not being issued. China is presently only issuing the following types of visas:

  • Business Travel (M visa)
  • Work Permits (Z visa)
  • Family Visit/Family Reunion visas
  • A limited number of student visas

Further, all visas issued prior to March 2020 are currently suspended. This includes existing 5- and 10-year visas, even those that are still valid and have not reached their expiration date. Anyone holding one of these visas, who wishes to travel to China, will need to apply for a new visa in one of the classes noted above.

Travelers entering China need to present a negative PCR (nucleic acid) test, though there are reports this requirement may be relaxed by the Chinese government on a country-by-country basis. Currently, 22 governments (including Australia, Canada, France, Spain, the United Kingdom, and the United States) currently require individuals coming from China to provide a negative PCR test to enter their countries.

After earlier bans on citizens of Japan and South Korea, Chinese consulates in these countries have resumed issuing entry visas.

Because of both pent-up demand for travel to China and staffing shortages at consulates, visa issuance and processing times are subject to delays. CIBT recommends anyone planning on traveling to China budget ample time to complete the visa application process before your expected travel date.

The South Korean government is once again issuing short-term visitor visas to travelers from China. South Korea resumed issuing these visas on 11 February 2023.

Earlier, China also resumed issuing short-term visitor visas for South Korean citizens to China, effective from 18 February 2023. The port visa and 72/144 hour visa free transit policy to Korean citizens have also been reinstated as well.
